Kyle's experience with litigating, and ultimately resolving, over one-thousand cases, has helped him develop an extensive repertoire of approaches that can be tailored to fit the needs of your matter. Kyle has settled significant litigation from both the plaintiff and defense side, involving legal areas that include all aspects of IP, complex commercial, class and collective actions, antitrust, False Claims Act, labor and employment (including wage and hour), personal injury, mass tort, product liability, shareholder litigation and international arbitration.
Most recently Kyle served as General Counsel for privately held Epic Systems, the leading provider of electronic health record software. Prior to joining Epic, Kyle spent over a decade as Deputy General Counsel for Litigation at international consumer goods company Kimberly-Clark. In that role he led the team that was responsible for handling all of Kimberly-Clark’s global disputes and government investigations. Kyle managed litigation involving competitors, customers, suppliers, individuals and government agencies.
Earlier in his two-decade career at Kimberly-Clark, Kyle held a number of leadership roles, including Chief Intellectual Property Counsel and Chief Counsel--Innovation. Notably, Kyle was a chief architect in the successful resolution of the "Diaper Wars," the decades long IP litigation between Kimberly-Clark and Procter & Gamble.
Kyle began his career in private practice focusing on complex IP trial work. Kyle handled bench and jury trials in multiple US District Courts as well as appeals in the Court of Appeals for the Federal Circuit. Kyle is also registered to practice before the United States Patent and Trademark Office.
Over the course of his career Kyle has had first-hand experience advising clients and litigating matters in a variety of business sectors, including consumer products, healthcare, software, medical devices, medical supplies, automotive, and industrial products.
